Milton Company Fined $60,000 After Worker Injured in Workplace Incident

A Milton metal distributor has been fined $60,000 after an employee was injured when a bundle of metal rods fell during an inventory check, Ontario’s Ministry of Labour reports.
Fidelity PAC Metals Ltd., located at 855 Steeles Ave. E., pleaded guilty in Halton Provincial Offences Court to failing to comply with workplace safety requirements under Ontario’s Occupational Health and Safety Act. The penalty was issued on July 24 by Justice of the Peace Marsha Fernand.
The incident took place on Dec. 10, 2022, when an administrative employee was helping with inventory in the warehouse’s bar storage area. As the worker checked tags on a lower rack, a forklift operator removed a bundle of rods from an upper rack, causing another bundle to fall and strike the worker.
A ministry investigation revealed that the racks were too closely spaced, materials were not properly centered, and pedestrian exclusion zones had not been established.
Following the incident, Fidelity PAC Metals made several safety improvements, including realigning storage racks, marking exclusion zones, and replacing damaged equipment.
The court also imposed a 25 per cent victim fine surcharge, which contributes to a provincial fund supporting victims of crime.
